An Anambra State High Court, Neni Judicial Division but sitting in Ogidi and presided over by Justice Etomike Ndigwe, has refused to grant an application for stay of execution on its judgment on the Enugwu-Agidi Brotherly Union election delivered on 24th September, 2026.
The court had in the judgment nullified the town union election conducted on 29th December, 2025 and ordered a fresh election within 90 days.
Ruling on the application for stay filed by the defendant applicants, the court held that since it had already delivered judgment on the matter, granting a stay would be unnecessary and a mere academic exercise.
It, therefore, advised the applicants to go to the Court of Appeal to ventilate their grievance.
Speaking with newsmen immediately after the ruling, counsel to the respondent, Mr. Maduka Onwuemena, who hailed the ruling, explained that the court in its wisdom ordered the applicants to go to the Court of Appeal.
According to him, when a party files for stay after judgment, such application should first be made at the court of first instance that gave the judgment, and once refused, the party can proceed to the Court of Appeal.
He maintained that the election conducted on 17th October, 2026 remains valid as it was in compliance with the court judgment.
Reacting to the ruling, counsel to the applicant, Mrs. Anthonia Okoye, observed that what the court said was that the two parties should maintain the status quo pending the final determination of the matter at the Court of Appeal.
